Italian bikers: we invoke art. 3 of the Italian Constitution.

Milano, 6th May 2020 – 20,000 Italian bikers have joined the petition launched by Bikerface ‘s online community, asking the Government to authorize unlimited mileage rides on the national territory for all bikers. The current restrictions regarding social distancing, as of 4 May, envisage the possibility for citizens to go out into the open air and engage in physical activities. However, bikers are not allowed to ride their motorcycles for sports and recreational purposes, although this clearly constitutes neither a threat nor a breach of the anti-COVID-19 rules.
Bikers also argue that such activity can support the recovery of the national economy.

The initiative, launched by the app-community Bikerface, which counts on over 50,000 bikers registered in Italy, promoted the petition through its platform last April 25th, collecting up to 1000 members per hour.
Bikers therefore invoke the Italian Constitution, more precisely Article 3, which states that “the Republic is responsible for removing economic and social obstacles, which, by effectively limiting the freedom and equality of citizens, prevent the full development of the human person“. The “full development“, say the motorcyclists, also concerns the fulfilment of their passion.

Elmira Shahbazi and Greta Maspero, from Lexia Avvocati, assisted the Bikerface community in the legal aspects of the petition drafting and its presentation.
