Overview

Marco is Senior Associate at LEXIA and his primary focus is on litigation and dispute resolution on civil, commercial, real estate and corporate matters, both national and international.

He assists national and international clients before national courts. He gained significant experience on national (Arbitral Chamber of Milan) and international arbitration (ICC, AAA – ICDR).

Marco graduated in Law in 2015 at the Catholic University in Milan with a dissertation on punitive damages in Italian law and in the other countries of Western Europe. During his studies, he spent a year at the Pázmány Péter Catholic University in Budapest, Hungary, where he attended courses in European and International law.

In 2016 he obtained a Master’s degree (LLM equivalent) with high honours in Comparative Law from the University of Strasbourg in France, writing a comparative dissertation on class actions in Italy and France. In the same year, he attended a Summer School in European Private Law at the University of Salzburg, Austria.

In 2022 he attended a specialist course organized by the Fondazione Forense dell’Ordine degli Avvocati di Milano on national arbitration and a course organized by the European Court of Arbitration on international arbitration and maritime arbitration.

Marco boasts significant experience in corporate litigation and arbitration with particular focus on post-M&A matters and in international arbitration related to construction projects and, in general, in litigation involving cross-border matters.

Before joining LEXIA, Marco gained significant experience at leading national and international law firms.

Experience

Representation in a civil lawsuit on behalf of a leading asset management company operating in the real estate sector, concerning the breakdown of negotiations relating to a real estate transaction.

Legal representation in an ad hoc arbitration on behalf of an investment company concerning an investment transaction, where the interpretation of the “ratchet” incentive mechanism relating to the calculation of the exit premium was disputed.

Assistance in an international arbitration before the International Centre for Dispute Resolution of the American Arbitration Association on behalf of a leading Italian construction company.

Assistance in two ICC international arbitrations concerning the construction of a waste-to-energy plant abroad by a leading Italian construction company.

Out-of-court assistance for foreign individuals subject to European sanctions relating to Russia’s war against Ukraine, concerning frozen assets within the Italian Republic (liaising with the Financial Security Committee of the Italian Ministry of Economy and Finance, and the Italian State Property Agency).

Assistance to the board of statutory auditors of a joint-stock company in a lawsuit filed with the court pursuant to Article 2409 of the Italian Civil Code regarding serious management irregularities committed by the Sole Director.

Assistance in connection with numerous ordinary claw-back actions against members of the board of directors of a well-known Italian bank subject to compulsory administrative liquidation.
