On October 23, 2024, the Ministry of the Environment and Energy Security (“MASE”) published Decree No. 368 titled “Establishment of the unified digital platform for submitting authorization applications for renewable energy production plants.”
With Decree No. 368 of October 23, 2024, the Ministry of the Environment and Energy Security (MASE) established the unified digital platform for submitting authorization applications for renewable energy production plants (“Renewable Energy Plants” or “FER”), in implementation of Article 19 of Legislative Decree No. 199 of November 8, 2021 (“D.lgs. 199/2021”).
Pursuant to Article 19 of D.lgs. 199/2021, this platform is required to:
- provide guidance and assistance throughout all phases of the administrative procedure and
- ensure interoperability with the digital tools already in operation at the national, regional, provincial, or municipal levels for submitting applications.
Purpose
The unified digital platform for authorization applications, called the Piattaforma Suer (“Unified Renewable Energy Portal”), has been created for submitting the applications referred to in Article 4, paragraph 2, of Legislative Decree No. 28 of March 3, 2011 (“D.lgs. 28/2011”). These applications include:
a) Communication for free construction activities (“CILA”) under Article 6, paragraph 11, of D.lgs. 28/2011;
b) Certified Notice of Commencement of Works (“DILA”) under Article 6-bis of D.lgs. 28/2011;
c) Simplified Authorization Procedure (“PAS”) under Article 6 of D.lgs. 28/2011;
d) Single Authorization (“AU”) under Article 5 of D.lgs. 28/2011 (collectively, the “Applications”).
The Piattaforma Suer is developed and managed by the GSE, which also provides assistance and support to operators and Public Administrations through the platform. The GSE is not, in any capacity, a party to the proceedings initiated as a result of applications submitted through the Piattaforma Suer.
Function and operation of the Piattaforma Suer
The Piattaforma Suer:
- ensures its interoperability with existing digital tools at the national, regional, provincial, and municipal levels for submitting applications, as well as with platforms established at the GSE;
- allows for monitoring administrative procedures;
- provides guidance and assistance to Public Administrations and operators throughout all phases of the authorization process;
- enables the regular acquisition and exchange of data with other Public Administrations to simplify information flows and reduce the documentary burden on operators in obtaining authorization and permit titles, as well as state incentives for renewable energy enhancement.
The data necessary for the platform’s operation is supplied by the responsible administrations, operators, or the GSE using standard forms or its own digital channels (where available), in accordance with respective competences.
Submission of applications
Within 120 days of adopting the standard forms under Article 19, paragraph 3, of D.lgs. 199/2021, applications must be submitted through the Piattaforma Suer.
Applications may also be submitted using existing digital tools at the national, regional, provincial, or municipal levels, provided that:
- access to such tools is possible through a connection from the Piattaforma Suer;
- applications are submitted using the national standard forms adopted pursuant to Article 19, paragraph 3, of D.lgs. 199/2021;
- information regarding the procedures initiated on the platforms of the responsible administrations is automatically made available on the Piattaforma Suer through interoperability services provided by the receiving system (in accordance with methods established by the GSE in consultation with the Regions and Autonomous Provinces), thereby allowing for assistance throughout all procedural phases.
