LEXIA, with a team composed of partner Silvia Cossu, supported by partner Aurora Agostini, counsel Giulietta Minucci, and associates Sara Cazzaniga, Alessandro Carlini, and Giovanni Lombardi, successfully assisted a skilled gamer of the EA Sports FC video game in a precautionary proceeding initiated by the Lega Professionisti Serie A. The League was seeking to extend its audiovisual rights to matches played on console in EA Sports FC. The League argued that virtual actions, inspired by real-life football, constituted animated reproductions of protected images and, as such, should neither be created nor shared.
The Genoa Court fully dismissed the appeal, stating that console gameplay actions result from the player’s skill, not from a graphic reworking of real sports events, and therefore do not infringe on the League’s audiovisual rights.
