LEXIA in the proceedings against Google on the right to be forgotten: class injunction granted

LEXIA assisted a group of Italian users in class injunction proceedings brought against Google concerning the right to be forgotten. The Court of Milan upheld the claim.

In its decision, the Court ordered Google LLC to amend, by 15 November 2026, the procedures it uses to handle delisting requests. Two changes are required:

  • users must be able to attach supporting documentation to their requests;
  • where a request is rejected, Google must provide understandable reasons.

These are concrete measures that directly affect how people seeking the removal of content from search results can make their case and understand the outcome of their request.

As far as is known, this is the third class injunction granted in Italy, making it a significant precedent for the development of this form of legal protection.

The ruling is also particularly important for the right to be forgotten, as it shapes the way users can exercise their rights under the GDPR, strengthening transparency and the opportunity to be heard in their dealings with one of the world’s leading search engines.

The LEXIA team on the proceedings comprised Partner Silvia Cossu and Counsel Anna Russo, both members of the Litigation, Arbitration and Legal Risk Mitigation team, together with Managing Partner Francesco Dagnino.
