Giulio Marconcin

Giulio focuses his practice on civil and commercial litigation, and on domestic and international arbitration.

He advises Italian and international clients across a broad range of sectors, including industrial, private equity, real estate, and energy, in complex commercial, corporate, and civil disputes, including cross-border matters. He represents clients before Italian courts and in both institutional and ad hoc arbitration proceedings, including arbitrations administered by the International Chamber of Commerce (ICC) and the Milan Chamber of Arbitration (CAM).

Giulio has developed significant experience in civil and corporate litigation, with particular focus on directors’ and officers’ liability claims, challenges to shareholders’ and board resolutions, post-M&A disputes, and commercial contract litigation.

He also advises clients on non-contentious matters in the same areas, assisting with commercial contracts and corporate governance issues.

Prior to joining LEXIA, Giulio worked for several years with leading Italian and international law firms based in Milan.

During his professional career, he also completed a secondment with a leading US insurance company.

Represented a leading Italian energy company in a dispute concerning the alleged breach of a letter of intent.

Represented the Italian subsidiary of a leading multinational automotive group in a claim for damages relating to the alleged abuse of economic dependence.

Represented a Chinese-owned insurance company in connection with various litigation matters in Italy.

Represented a US multinational company operating in the manufacturing sector in a domestic arbitration proceeding before the Milan Chamber of Arbitration with reference to the breach of a joint venture agreement.

Represented a US private equity fund active in the aviation industry in a claw back action brought by a leading domestic aviation company.

Represented the minority shareholder of the holding company of an Italian energy group in a complex domestic arbitration proceeding before the Milan Chamber of Arbitration related to the breach and interpretation of a share purchase agreement as well as in several subsequent corporate litigation proceedings initiated before Italian courts.

Represented the sellers of an Italian company active in the food and beverage industry in a domestic arbitration proceeding before the Milan Chamber of Arbitration concerning alleged violations of the representations and warranties contained in a share purchase agreement.

Represented the minority shareholder of the holding company of an Italian group operating in the private equity sector in a corporate dispute related to the exercise of the withdrawal right.

Represented a domestic company operating in the waste recycling sector in an ad hoc domestic arbitration proceeding against the former members of the board of directors of the company concerning the breach of fiduciary duties.
